Terms of Service

1. Agreement to these Terms

These Terms of Service ("Terms") govern your access to and use of HomeJet, including the HomeJet website, business management tools, and homeowner marketplace (together, the "Service"). The Service is operated by 74mph Solutions ("74mph Solutions", "we", "us", or "our"), based in Ontario, Canada. By creating an account, claiming a listing, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

2. The Service

HomeJet is two connected things: free business management software for home service contractors, and a homeowner marketplace where the work a contractor completes builds their public ranking.

• The first Business Manager seat is free. We may offer additional paid features and subscription plans.

• Paid subscriptions are billed through our payment processor, Stripe. By purchasing a subscription you authorize the applicable recurring or one-time charges. Fees are stated at the point of purchase.

• We may add, change, or remove features over time, and we may set reasonable limits on use or storage.

3. Accounts

You must provide accurate information when you create an account and keep it up to date. You are responsible for keeping your password secure and for all activity under your account. Please notify us promptly if you believe your account has been accessed without authorization. Accounts are for use by the person or business that registered them.

4. Acceptable use

When using the Service, you agree not to:

• break any applicable law or infringe the rights of others;

• upload content that is unlawful, misleading, harmful, or that you do not have the right to share;

• post fake, incentivized, or manipulated reviews, or attempt to influence rankings through dishonest means;

• attempt to gain unauthorized access to the Service, other accounts, or our systems;

• interfere with or disrupt the Service, or use it to distribute spam or malware;

• scrape, copy, or resell the Service or its data except as expressly permitted.

5. Customer and business data

Contractors using HomeJet may enter information about their own customers, leads, jobs, quotes, and invoices. You are responsible for having the right to enter that information and for using it in line with applicable privacy laws. Our handling of personal information is described in our Privacy Policy.

6. Invoicing and payments

HomeJet provides invoicing and payment-tracking tools that a contractor uses for their own bookkeeping. A contractor can create and send invoices to their customers and record payments they have received. HomeJet does not process, collect, hold, or transfer any payment between a contractor and their customer or homeowner. Payments for contractor services are arranged and made directly between the contractor and their customer, outside of HomeJet, by whatever method they agree on. Amounts and payment statuses shown in HomeJet reflect what the contractor has entered and are for record-keeping only. They are not proof that funds were received and are not a guarantee of payment. This is separate from the subscription fees for HomeJet itself, which are processed by Stripe as described in Section 2.

7. Marketplace, reviews, and JetScore

HomeJet is a directory and introduction platform. We are not a party to any contract, quote, agreement, or transaction between a homeowner and a contractor, and we do not perform home service work. Any agreement for services is solely between the homeowner and the contractor. We do not guarantee the quality, safety, licensing, or legality of any contractor or the work they perform, and you should use your own judgment when hiring.

Reviews are submitted by people connected to completed jobs and are invited by the contractor. JetScore is an informational ranking calculated from factors such as review quality, responsiveness, review recency, and verified-job ratio. Ranking on HomeJet is earned, never bought. Money is never in the JetScore formula, and reviews are never suppressed for commercial reasons. We may remove content that violates these Terms.

Reviews you submit are public. Your reviewer name is shown as your first name and last initial, and a public reviewer profile displays the reviews you have written and the average rating you give, so others can assess your reviews in context. You are responsible for your reviews and must not post content that is false, abusive, or that contains personal information. We may remove reviews that violate these Terms or our review guidelines.

8. Intellectual property

The Service, including its software, design, and the HomeJet and 74mph Solutions names and logos, is owned by 74mph Solutions and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms. You keep ownership of the content you submit, and you grant us the rights needed to host, display, and operate the Service, including showing business profiles and reviews publicly.

9. Third-party services

The Service relies on third parties such as Stripe for payments, email delivery providers, and analytics providers. Your use of those services may be subject to their own terms. We are not responsible for third-party services.

10. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you break these Terms, if required by law, or to protect the Service or other users. Sections that by their nature should survive termination, such as intellectual property, disclaimers, limitation of liability, and governing law, will continue to apply.

11. Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any listing, review, or JetScore reflects a guarantee of outcome.

12. Limitation of liability

To the fullest extent permitted by law, 74mph Solutions will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred Canadian dollars.

13. Indemnification

You agree to indemnify and hold harmless 74mph Solutions from claims, losses, and expenses arising from your use of the Service, your content, or your breach of these Terms, to the extent permitted by law.

14. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. The courts located in Ontario will have jurisdiction over any dispute, subject to any rights you may have under applicable consumer protection law.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the date below and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
